This End User License Agreement ("Agreement") is a legal agreement between you and MrMoustache for the use of MrMoustache software products and audio plugins ("Software"). By installing or using any MrMoustache Software, you agree to be bound by the terms of this Agreement.
MrMoustache grants you a revocable, non-exclusive, non-transferable license to install and Use the Software for your personal or commercial audio production. This license is granted to you as an individual, not to a company or organization.
You may activate the Software on a limited number of computers that you own or control, as defined by the number of activations associated with your license at the time of purchase. The license is for one natural person and may not be used concurrently by multiple users. Organizations, studios, schools, and labs need separate licenses.
The Software includes an activation and deactivation system that lets you manage your activations from within the plugin. You can deactivate an installation to free up a seat and activate the Software on another machine. If you have used all your activations and need to transfer your license, please contact support at support@mrmoustache.es.
Once activated, the Software can run without an internet connection. Should the license server become permanently unavailable, MrMoustache will make commercially reasonable efforts to keep existing activations working or to provide an alternative authorisation mechanism.
You may make a reasonable number of backup copies for archival purposes only.
The Software is licensed, not sold. MrMoustache retains all rights, title, and interest in and to the Software and all copies, including all code, graphics, sounds, and documentation. No rights are granted except as expressly stated. Any music or audio content you create using the Software is entirely yours.

Certain plugins may be available as a trial version for a limited period of fourteen (14) days. The trial version provides full functionality. After the trial period expires, you must purchase a license to continue using the Software. Trial licenses are not transferable.
By completing the purchase, you give your express consent for the performance of the contract to begin immediately and acknowledge that the product is delivered as a digital download. In accordance with applicable consumer protection laws, you thereby waive your right of withdrawal. Since all products are delivered as digital downloads, refunds, returns, or exchanges are not possible once the download has been completed or access to the Software has been provided.
Updates, upgrades, patches, and fixes (collectively, "Updates") may modify or remove features. Updates are part of the Software and are governed by this Agreement. MrMoustache has no obligation to provide Updates and may offer paid upgrades for new versions.
Information about what we collect and how we use it is described in our Privacy Policy. If you do not agree, do not use the Software.
The Software may include third-party libraries or open-source components. Their respective licenses apply to those components. Notices are provided in the Software or on our website.
This license is non-transferable and may not be resold or assigned without our prior written consent. Trial and beta licenses are not transferable. Any attempted transfer in violation of this section is void.
To the maximum extent permitted by law, the Software is provided "as is" and "as available" with all faults. MrMoustache disclaims all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, MrMoustache will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or cost of substitute goods or services, even if advised of the possibility. In no event will the total liability of MrMoustache for all claims exceed the amount you paid for the Software that gave rise to the claim.
You will indemnify and hold harmless MrMoustache from third-party claims, damages, and costs, including reasonable legal fees, arising out of your breach of this Agreement or misuse of the Software.
This Agreement is effective until terminated. MrMoustache may terminate it immediately if you materially breach it. Upon termination, you must stop using the Software and destroy all copies. MrMoustache may disable license credentials to enforce termination.
This Agreement is governed by the laws of Spain. The exclusive venue for any dispute is the courts of Barcelona, Spain, and you consent to personal jurisdiction there.
As the copyright holder of the Software and all associated content, MrMoustache hereby makes a reservation of rights for the purpose of all activities constituting text and data mining. This reservation applies to all works in which MrMoustache holds copyright, to the extent that such works comprise, in whole or in part, any type of disseminated content. Any acts of text and data mining carried out in relation to content that includes works in which MrMoustache holds copyright, without obtaining prior written authorization, shall constitute an infringement of MrMoustache's rights.
This is the entire agreement regarding the Software and supersedes prior understandings. If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. We may provide notices electronically to the email you provided, within the Software, or on our website.
